Abstract

Like many other countries South Africa is faced with the challenge of dealing with corporations that commit crimes. In this article the concept of corporate criminal liability in the South African context will be closely examined with the aim of highlighting its importance. The discussion will include, inter alia, the basis for corporate criminal liability in South Africa, the common law regulation of corporate
criminal liability, the development of the statutory regulation thereof, as well as constitutional aspects of corporate criminal liability.
